VidBerry ("we", "our", or "us") respects your privacy. This Privacy Policy explains how we collect, use, and protect your information when you use the VidBerry mobile application.

1. Information We Collect

1.1 Account Information

• Apple ID information (if you sign in with Apple)

• Generation history
• Credit transactions
• App usage analytics

1.3 Device Information

• Device type and model
• Operating system version
• Unique device identifiers

• Images you upload for processing
• Prompts you enter for AI generation
• Generated content (videos, images)

1.5 Face Data

When you use our AI generation features (such as photo transformation, face swap, or video creation), photos you upload may contain facial imagery. We collect only the raw photo file you explicitly select from your photo library or camera. We do not collect biometric face data, face maps, facial geometry, or Face ID data.

1.5.1 Third Parties We Share Face Data With

We share face data with one third party: Fal.ai (operated by fal.ai, Inc., https://fal.ai). This is our sole third-party AI processing provider. No other third parties receive face data.

1.5.2 Reasons for Sharing Face Data

We share face data with Fal.ai for the following specific purpose: to process the user's uploaded photo through AI models that generate transformed images and videos as requested by the user (e.g., style transfers, photo enhancements, face swap effects, video generation). Face data is shared solely to fulfill the user's explicit generation request. Face data is not shared for advertising, analytics, profiling, facial recognition, or any purpose other than generating the AI output the user requested.

Before any face data is shared with Fal.ai, the app displays a mandatory Data Processing Consent screen that clearly identifies Fal.ai as the recipient, explains what data will be sent, and requires the user to provide explicit consent via a checkbox before proceeding. The app cannot be used without accepting this consent.

1.6 Third-Party Face Data Storage (Fal.ai)

We share user-uploaded photos (which may contain face data) with our third-party AI processing provider, Fal.ai (operated by fal.ai, Inc.). Below we describe whether Fal.ai stores face data, and if so, why and for how long:

Does Fal.ai store face data? Yes, Fal.ai temporarily stores face data during and briefly after processing. Fal.ai does NOT permanently store face data.

• What face data is stored: The uploaded photo file containing facial imagery, as submitted by the user for AI generation.
• Why face data is stored: Temporary storage is technically required to (1) process the AI generation request (the model must access the image data during computation), and (2) make the generated output available for download by the app after processing completes.
• How long face data is stored: Input images (including face data) are held in processing memory for the duration of the generation task only (typically seconds to minutes) and are purged immediately upon task completion. Generated output files are stored for up to 24 hours to allow retrieval by the app, after which they are automatically and permanently deleted from Fal.ai's servers.
• Why face data is stored for this length of time: The brief processing-time storage is necessary because the AI model requires access to the image during computation. The 24-hour output retention exists solely to ensure reliable delivery of results to the user, accounting for network delays or app backgrounding. No longer retention is necessary or performed.
• No model training: Face data is never used to train, fine-tune, or improve AI models. Fal.ai's terms of service prohibit using customer data for model training.
• Fal.ai's privacy practices: Fal.ai maintains its own privacy policy at https://fal.ai/privacy. Fal.ai provides the same or equal protection of user data as described in this privacy policy, including restrictions on data use, storage limitations, and deletion practices.

Generated output files (which may contain facial imagery) are stored in your personal library within the app and can be deleted at any time. Upon account deletion, all associated generated content is permanently deleted from our servers.

Face data is not sold, shared for advertising purposes, used for facial recognition, or provided to any third party other than Fal.ai for the sole purpose of generating your requested content.

2. How We Use Your Information

We use your information to:

• Provide and improve our services
• Process your AI generation requests
• Manage your account and credits
• Send service-related notifications
• Analyze usage patterns to improve the app
• Comply with legal obligations

3. Data Storage and Security

3.1 Storage

Your data is stored securely on servers managed by Supabase. Generated content is stored temporarily and may be deleted after a period of inactivity.

3.2 Security

We implement industry-standard security measures to protect your data, including encryption in transit and at rest.

4. Data Sharing

We do not sell your personal information. We may share data with:

• AI service providers (Fal.ai, Google) to process your generation requests
• Analytics providers to improve our service
• Legal authorities when required by law

5. Your Rights

You have the right to:

• Access your personal data
• Correct inaccurate data
• Delete your account and data
• Export your data
• Withdraw consent for data processing

To exercise these rights, use the settings in the app or contact us.

6. Data Retention

We retain your data for as long as your account is active. After account deletion, we delete your data within 30 days, except where retention is required by law.

Face data retention: Photos you upload for AI processing are not stored on our servers. They are transmitted directly to our AI processing provider, processed in real-time, and deleted immediately after generation is complete. Generated outputs containing facial imagery are retained in your personal library until you delete them or delete your account.

7. Children's Privacy

VidBerry is not intended for children under 13. We do not knowingly collect data from children under 13. If we discover that we have collected personal information from a child under 13, we will promptly delete that information.

8. International Transfers

Your data may be transferred to and processed in countries other than your own. We ensure appropriate safeguards are in place for such transfers.

9. KVKK Compliance (Turkey)

For users in Turkey, we comply with the Personal Data Protection Law (KVKK). You have the right to:

• Learn whether your data is processed
• Request information about data processing
• Learn the purpose of processing
• Know third parties to whom data is transferred
• Request correction of incomplete or incorrect data
• Request deletion of your data
• Object to processing
